In case a copyright owner identifies that their work is being infringed upon, they must issue a formal notice to Ping Browser under Section 52(1)(c) of the Copyright Act, 1957, to inform about the infringement.The notice should contain the following details:
- A description of the copyrighted work with adequate information to identify the work.
- Details establishing that the complainant is the owner or exclusive licensee of the copyright in the work.
- Details establishing that the copy of the work in question is an infringing copy of the work owned by the complainant and that the infringement is not permitted under the Copyright Act.
- Details of the location where the infringing content is being stored or made available.
- Details of the person, if known, who is responsible for uploading the infringing content.
Once the notice is received, Ping Browser will review and may upon its satisfaction take action and remove the infringing content within 72 hours of receiving such a notice, as per the Intermediary Guidelines Rules, 2023.
